1. About these terms
These Terms & Conditions apply to appointment requests and nail services provided by Nail Atelier, a home-based nail studio operated by Dana in Cebu City, Philippines. By submitting a booking request and accepting these terms, you confirm that you have read and understood them.
A submitted request is not yet a confirmed appointment. A booking becomes confirmed only after Nail Atelier accepts the requested schedule, confirms the expected service and price, and communicates any required deposit.
2. Services and pricing
Displayed prices are starting prices. The final price depends on the selected base service, design tier, length, removal, repairs, materials, and other details. Nail Atelier will disclose and obtain your agreement to material price changes before starting the affected work.
Reference photos are used as inspiration. Exact duplication is not guaranteed because nail size, condition, available materials, artist technique, lighting, and image editing can affect the result.
3. Appointments, lateness, and rescheduling
Please book at least 12 hours in advance. If you need to reschedule or cancel, give at least 24 hours' notice where reasonably possible. Arriving 10–15 minutes late may require shortening, changing, or rescheduling the service so later clients are not delayed.
Because the studio is home-based with limited space, guests are not allowed unless agreed in advance. Nail Atelier may reasonably refuse or stop a service for safety, hygiene, abusive conduct, or non-compliance with studio policies.
4. Deposits, cancellations, and no-shows
If a deposit is required, its amount and payment instructions will be disclosed before confirmation and it will be credited toward the final service price. A deposit may be transferred once to a new date when at least 24 hours' notice is given, subject to availability.
For cancellation within 24 hours or a no-show, a deposit may be retained as reasonable compensation for the reserved time and costs already incurred. Emergencies will be considered fairly. If Nail Atelier cancels and no suitable replacement schedule is agreed, any deposit paid for that appointment will be returned.
5. Health, allergies, and service suitability
You must disclose before the service any known allergies, sensitivities, nail or skin conditions, infections, injuries, current medication affecting nails or skin, or previous adverse reactions relevant to the service. Nail Atelier is not a medical provider and does not diagnose or treat medical conditions.
Service may be postponed or refused when there are signs of infection, open wounds, inflammation, or another condition that may make treatment unsafe. Seek qualified medical advice when appropriate. Products are used with reasonable care, but individual reactions can occur even without a known allergy.
6. Aftercare and durability
Follow the aftercare guidance provided, avoid using nails as tools, and promptly report unusual pain, swelling, irritation, lifting, or damage. Wear time varies with nail condition, lifestyle, aftercare, and accidental damage.
Where practical, contact Nail Atelier within 48 hours of noticing an application concern and provide clear photos so it can be assessed promptly. This notice period helps with assessment but does not remove any right or remedy that cannot lawfully be waived.
7. Complaints and remedies
If you are unhappy with the service, contact Nail Atelier through Instagram or mobile as soon as reasonably possible. Nail Atelier will review the concern in good faith and may offer an appropriate correction, partial refund, refund, or another lawful remedy depending on the circumstances.
Completed personal services are not automatically refundable for a change of mind, but nothing in these terms excludes remedies available for a defective, unsafe, misrepresented, or non-conforming service under applicable Philippine law. Complaints should first be raised directly so both parties can try to resolve them promptly.
8. Client conduct, belongings, and the home studio
Clients must act respectfully and follow reasonable hygiene and safety instructions. Nail Atelier is not responsible for loss or damage to personal belongings unless caused by its negligence or willful misconduct. The studio address should be treated as private and should not be published or shared without permission.
9. Minors
Clients under 18 must have permission from a parent or legal guardian. Nail Atelier may require the guardian to confirm consent or attend the appointment, particularly for younger clients, before a service is performed.
10. Photos and social media
Nail Atelier may ask to photograph completed nail work. Photo consent is optional, will be requested separately, and is not a condition of receiving service. You may decline, ask that identifying features be excluded, or withdraw permission for future use by contacting Nail Atelier. Withdrawal does not affect lawful use that occurred before withdrawal.
11. Privacy notice
Booking information may include your name, mobile number, Instagram handle, preferred date and time, selected services, extras, notes, and relevant health information you choose to disclose. Nail Atelier uses it to respond to your request, arrange and perform services, manage payments or disputes, keep necessary business records, and comply with law.
This website prepares your request on your device and does not maintain a booking database. Information you choose to send by SMS, Instagram, or another channel will be received and handled by Nail Atelier and may also be processed under that channel provider's own privacy policy.
Information will be limited to what is reasonably necessary, protected with appropriate safeguards, and retained only as long as needed for the stated purpose, legitimate business records, dispute handling, or legal obligations. It will not be sold. It may be disclosed only to service providers necessary for communications or payment, professional advisers, or authorities when lawfully required.
You may ask to access or correct your information, object or withdraw consent where applicable, request deletion when there is no lawful reason to retain it, or raise a privacy concern by contacting Nail Atelier through Instagram or 0907 912 1302. You may also lodge a complaint with the National Privacy Commission.
12. Liability and non-waivable rights
To the fullest extent permitted by law, Nail Atelier is responsible only for loss or damage that is a reasonably foreseeable result of its breach, negligence, or willful misconduct. It is not responsible for damage caused by undisclosed conditions, failure to follow aftercare, accidental damage, work by another provider, or events beyond reasonable control.
Nothing in these terms excludes or limits liability where exclusion is prohibited, or removes rights and remedies that cannot be waived under the Consumer Act, Data Privacy Act, Civil Code, Internet Transactions Act, or other applicable Philippine law.
13. Changes, severability, and governing law
Nail Atelier may update these terms for future bookings. The version accepted at the time of a confirmed booking applies to that appointment unless both parties agree otherwise. If any provision is invalid or unenforceable, the remaining provisions continue to apply to the extent allowed by law.
These terms are governed by Philippine law. The parties should first attempt good-faith direct resolution. This does not restrict a client from seeking help or remedies from the Department of Trade and Industry, National Privacy Commission, courts, or another competent authority.
